Q. If I have a will, does that avoid probate?

A. No. The will just tells the probate estate where you want your property to go, and who you want to administer your estate.  All property in your name alone goes through probate.  To avoid probate you must have all property titled in a form that passes automatically at your death, such as through beneficiary designations, transfer on death provisions, joint title, or a revocable living trust.
