HHS Extends Deadline for Attestation, Acceptance of Terms and Conditions for Provider Relief Fund Payments to 45 Days


On May 7, 2020, the Department of Health and Human Services (HHS) announced a 15-day extension for providers who received Provider Relief Funds to sign their attestation. Any provider who received funds must either attest to the HHS Terms and Conditions or return the funds. By doing neither, HHS will assume the provider signed the attestation agreeing to all terms and conditions
Under the previous guidance, providers had 30 days to execute the attestation. New guidance extends this time to 45 days. This increases the deadline from May 9, 2020, to May 24, 2020, for those that received the first-round distribution on April 10, 2020. Providers must also execute the attestation before applying for the second-round distribution of the Provider Relief Fund.
Many providers have been awaiting further guidance from HHS on the reporting requirements for the Provider Relief Fund. HHS has not issued guidance on reporting requirements as of May 7, 2020. This extension gives HHS additional time to issue the guidelines before requiring providers to sign the attestation.
